Task three: Four ways to fix a broken legal system by: Philip Howard.

Law students are taught to apply a constitution for defending and judging people, however, it has been written according to old scenarios and different human circumstances. There has never been a perfect society and now less than before. Howard brings out four proposes which must be looked under a microscope before driving someone’s issue into a positive or negative result. Unfortunately, laws do not answer perfectly to everybody’s issues, since society changes constantly and dramatically. Likely, bias can be avoided if laws were designed with passion and into a more humanized way without pretending to say that everybody can do whatever they want.

The eigenvalues of humans over time have been eroded, putting the company in a more insecure position versus individual debauchery, so Mr. Howard stated that the law was created to address this type of behavior, but with the passage of time the law has become unstable and Howard proposes methods to satisfy these legal requirements: legal decisions are taken in a social sense and not individual, teach people to trust in the law, the law left room for problems children as a right of freedom, all this in order to make the law simpler and purer with people.

  9. Philip Howard criticizes legal enforcement in america, as we found that in most of these countries is not simply apply what the rules are in addition also the use of force. This makes our proposed consideration very useful for our legal system.
    First, a judge is very important since it is a high court order.
    Second, misapplication or non-application of the law has caused people do not trust the law : trust in the law is paramount .
    Third, we know that the law creates a barrier action or omission of the negative and positive action man , that is why the man is free by law freedom with limits.
    Room to reach a full freedom is necessary to simplify the law , ie you do not need many codes , rather a legal standard that applies to everything. Another option is to restore the authority because without it a State could not govern , you need a ruler to guide a country.

In the video Philip Howard talks about amending the law of human behavior tells us that judges apply the law but giving many freedoms to people living in the USA so gives some improvements for better control system and laws USA, speaking of the judges said that they should focus more on the community that I personally limit the law, change the way you judge to have more freedom, and for my opinion to change the judging system I think you should first start with new generations since children are growing up and to have a better way to apply freedom.

His four step system condenses the law into easy steps capable of changing how the law is used on a daily basis. When you reduce the ability to take risks, society finds itself at a stalemate. The present legal system ensures that risks cannot be taken without consequences. Life is not about wondering what is on the other side of the mountain. Life is about trekking over the mountain and seeing it for yourself. The current legal system prevents that from happening, leaving people in the wrong state of mind to make law less restrictive.

  19. Philip Howard addresses the audience with a speech that proposes ways to overhaul and simplify the justice system in order to make it easier for the general public to understand it and not become paralyze by it.
    His first proposition suggests that law should be judge by its effect on society, not on individual situations. This way people won't feel as threaten to perform their professional and even civic duties, as is the case with doctors, who many times chose not to get involved in the care of a patient for fear of a lawsuit.
    Second proposition affirms that trust in law is an essential condition of freedom; distrust skews behavior towards failure. To prove this Mr. Howard points out studies that show that when people are made self conscious of their judgements they end up making bad judgement calls.
    Third proposition states, that law must set boundaries protecting and open field of freedom, not intercede in all disputes. More specifically, he adds, the boundaries for lawsuits must be rebuilt, as these boundaries control the freedom of the rest of society.
    The fourth and last proposition explains how to rebuild the boundaries of freedom. First, it is imperative to simplify the law, so that every individual can understand it and internalize facilitating the every day decision making process. Second, by restoring authority to judges and officials to apply law.
    He concludes by saying that what the world needs is to restore authority to make common choices; the only way to release the love an passion from people in order to tackle the challenges of our times.

He said that all of the lways that now we have and we applying in the courts to judge the people. they were made form diferent people who lived in a different circunstances as we are, they don't look the problems with a passional way it means more human more affective they just did them mechanic.

Law has become so dense over the last two decades, that even during the interview process, the interviewer cannot legally ask where their client was from. This restrictive legal policy is quite binding and needs to be simplified and restructured, The current legal system prevents that from happening, leaving people in the wrong state of mind to make law less restrictive, The law needs to protect the rights of people around the world, not prohibit someone from committing every act possible. Therefore, the only logical thing for an average person to do is judge law based on our own individual experiences. Everyone has their own personality, and we all have different forms of morality. The real issue today with law is morality. When a human finds something to be morally repulsive, they act on it with severe intensity. This intensity drives them to want change the law to what they think is fair on an individual basis. However, the law would only become more complex with the focus on individual situations. The law needs to be simplified in order to ensure that the average human can understand and retain the law for what it is.
